Terms and Conditions of Sale
These terms and conditions relate to supply only. Additional terms are available if DVS are required to carry out installation work.
DVS always endeavour to take a fair and reasonable approach to dealing with any issues that may arise, and in almost all cases we are able to resolve any queries amicably.
Definitions of Sale
The Goods – all articles and/or services sold to you, including replacements for the defective goods.
The Contract – the contract between the vendor and the purchaser.
General Conditions
These Terms and Conditions shall apply in full, except where different terms or conditions have been agreed in writing by the two parties.
Prices
All prices for Goods and services paid by you will be in £ sterling, unless otherwise agreed.
Prices will be fixed and firm once the order has been accepted by us, and may only be varied if the specification changes, or delivery is substantially delayed by the Purchaser. Any adjustments will be fair and reasonable, and subject to agreement by the two parties.
Value Added Tax
All prices and charges quoted are exclusive of Value Added Tax, which will be added in accordance with prevailing legislation.
Documentation
The invoice incuding VAT will be printable from the web site and will also be emailed on completion of order.
Extent of Contracts
No binding contract will be created until we have accepted your order.
Quality Assurance
All Goods detailed in our on our web site have are processed in strict conditions with standard quality procedures, approved by BS EN ISO 9001.
DVS also conform to BS EN ISO 14001
General Descriptive Matter
(i) All specifications, drawings and particulars of weights, dimensions, capacity or other details offered are intended merely to give a general idea of Goods, but will not form part of the contract.
(ii) Unless otherwise stated, electrical ratings represent safe working limits. Dimensions and other physical characteristics are subject to normal commercial tolerances.
(iii) We reserve the right, without prior notice, to discontinue or make design changes to the Goods as part of a continuous programme of improvement, or to assist availability.
Guarantee
(i) Any defects which under proper use appear in the Goods within a period of 12 months (unless otherwise stated) after delivery and which are due to faulty materials, workmanship or design, will be made good by us either by repair or, at our option, by replacement provided that the Goods or the defective parts are returned to us, carriage paid and suitably packaged, within the 12 month period, together with a claim in writing which specifies the date of purchase. No Goods may be returned for credit unless previously agreed with us. Our sole obligation and your sole remedy under this provision is limited to the cost of repair or replacement of the Goods supplied. Where the Vendor installs the Goods, the guarantee will extend to cover the installation work, however we reserve the right to charge where the problems are not covered by the warranty (such as misuse, or problem found to be the responsibility of others).
(ii) These guarantees are in addition to your statutory rights as governed by the Laws of England.
Payment Terms
Payments for web purchases will be made at the time of ordering by credit or debit card.
Property
The property in the Goods shall pass to you when all sums due or owing to us by you been transferred to DVS account and the goods have been safely delivered to you.
Insurance for goods in transit to you is covered by DVS.
Variations
If we are given instructions by a representative of the Purchaser which varies the content of the order then we reserve the right to charge for such variations. All variations will be subject to discussion, and will be fair and reasonable to both parties.
Force Majeure
If the performance of the Contract or any other obligation under it is prevented, restricted or interfered with by any reason or circumstances beyond the reasonable control of the party obliged to perform it (other than financial) the party so affected upon giving prompt notice to the other party shall be excused from performance to the extent of prevention, restriction or interference, but the party so affected shall use its best efforts to avoid or remove such causes of non-performance and shall continue performance under the Contract with the utmost despatch whenever such causes are removed or diminished.
Limitation of Liability
Our liability is limited to fulfilling the contract, to supply the Goods ordered to be fit for the purpose supplied. We accept no consequential losses, or claims of any kind that are not covered by our insurance policies. Details of our insurance policies are available on request.
Legal Construction
All Contracts between us shall by and interpreted in accordance with the Laws of England, and the parties submit to the jurisdiction of the English Courts, but we may enforce any such contract in any court of competent jurisdiction.
